The following frank comments on the subject of analysis, though they obviously represent a preliminary examination af some of the problems that emerge between philosophical analysis and phenomenology as the two major trends in contemporary philosophy, are conceived by the present author in a much broader manner than the mere confrontation of two apparently opposing schools of thought. Due to the emergent nature of these themes, some adagio, others allegro, it has been impossible to arrange them in the usual systematic (...) manner. Whatever in these comments is "offensive" to either phenomenologist or analyst derives from the fact that this is only a preliminary study, in which the author is orienting himself and preparing for more systematic and thorough-going dialogue with sympathetic analyst friends and phenomenologist critics. What is presented here to friend, foe, and general philosophical reader, is a selection of themes that have puzzled me greatly. I offer them without any of the usual excuses and with the hope that to some extent this discussion may bring philosophers together, so that we can begin to lind the common ground, on which to make our contribution to contemporary thought the more truly convincing. In light of the variety of uses of the term autonomy in recent bioethics literature, in this paper, I suggest that competence, not being as contested, is better placed to play the anti-paternalistic role currently assigned to autonomy. The demonstration of competence, I will argue, can provide individuals with robust spheres of non-interference in which they can pursue their lives in accordance with their own values. This protection from paternalism is achieved by granting individuals rights to non-interference upon demonstration of (...) competence. In this paper, I present a risk-sensitive account of competence as a means of grounding rights to non-interference. On a risk-sensitive account of competence individuals demonstrate their competence by exercising three capacities to the extent necessary to meet a threshold determined by the riskiness of the decision. These three capacities are the capacity to acquire knowledge, use instrumental rationality, and form and revise a life plan. (shrink)

In _Pharmaceutical Freedom_ Professor Flanigan argues we ought to grant people self-medication rights for the same reasons we respect people’s right to give (or refuse to give) informed consent to treatment. Despite being the most comprehensive argument in favour of self-medication written to date, Flanigan’s _Pharmaceutical Freedom_ leaves a number of questions unanswered, making it unclear how the safe-guards Flanigan incorporates to protect people from harming themselves would work in practice. In this paper, I extend Professor Flanigan’s account by discussing (...) a hypothetical case to illustrate how these safe-guards could work together to protect people from harms caused by their own ignorance or incompetence. The authors identify the challenge of holding contemporary business leaders accountable for enhancing the intangible strategic asset of integrity capacity in organizations. After defining integrity capacity and framing it as part of a strategic resource model of sustainable global competitive advantage, the stakeholder costs of integrity capacity neglect are delineated. To address this neglect issue, the authors focus on the cultivation of judgment integrity to handle behavioral, moral and hypothesized economic complexities as key dimensions of integrity capacity. Taking a critical look at some of the recent controls over human life, health, and death, Fletcher draws a vivid picture of contemporary biological needs and ethical responsibility. Genetic engineering, fetal research, abortion, suicide, human experimentation, infanticide, and euthanasia are some of the issues explored.

The authors propose the integrity capacity construct with its four dimensions (process, judgment, development and system dimensions) as a framework for analyzing and resolving behavioral, moral and legal complexity in business ethics' issues at the individual and collective levels. They claim that moral progress in business comes about through the increase in stakeholders who regularly handle moral complexity by demonstrating process, judgment, developmental and system integrity capacity domestically and globally.

It is generally agreed that the method of explication consists in replacing a vague, presystematic notion (the explicandum) with a precise notion (the explicatum) formulated in a systematic context. However, Carnap and others who have used this and related terms appear to hold inconsistent views as to what constitutes an adequate explication. The central feature of the present explication of 'explication' is the correspondence condition: permitting the explicandum to deviate from some established "ordinary-language" conventions but, at the same time, requiring (...) that the explicatum correspond (via an effective translation) to the chosen "definitive intension" of the explicandum. (In effect, the first stages of an explication provide an informal characterization of a vague and possibly inconsistent language convention.) The present account of explication contrasts sharply with that sketched by Quine in Word and Object (although Quine accepts a correspondence condition of a sort). The terms `explication 1 ' and `explication 2 ' are used to indicate these quite different senses of the term. In Kaplan's terminology, explication 1 is intended to remedy "external vagueness" while explication 2 is intended to remedy "internal vagueness.". (shrink)

In this paper we argue that the difference between standard measurement and proxy measurement in paleoclimatology should not be understood in terms of ‘directness’. Measurements taken by climatologists to be paradigmatically non-proxy exhibit the kinds of indirectness that are thought to separate them proxy measurement. Rather, proxy measurements and standard measurements differ in how they account for confounding causal factors. Measurements are ‘proxy’ to the extent that the measurements require vicarious controls, while measurements are not proxy, but rather ‘standard’, to (...) the extent that the measurement apparatus provides sufficient physical control on its own. Guided by this account of proxy measurement, we then consider some of the challenges specific to historical proxy measurement and how it is that historical scientists address these challenges. Historical scientists rely on significant causal dependencies and naturally preserved signals to mitigate the influence of destructive processes over time. (shrink)

When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

However, in their eagerness to convince us of (...) the smallness of the sacrifices, I think the authors use some unfortunate rhetorical devices and move much too quickly over some necessary distinctions.The rhetorical display is unfortunate if the article is intended to be a fair and rational development of an argument--e.g., those who hold a position in opposition to the authors do not argue they "inveigh." The section on the political area of the controversy seems particularly dismissive of other's positions.However, I will focus on just two areas where I think a more nuanced consideration would make the question of the moral legitimacy of the "small sacrifices" of embryos less obvious than the authors' rhetoric would suggest.First, they claim that opponents of such research assume some sort of "super status" for an embryo. The rights generally conceded to born human beings may not be as "weak" as they characterize. But even considering only the "negative right against unwarranted violence," I think the authors misdescribe the situation. Contrary to their assertion, I do not know when "adults and even children are... forced to give life... in the defense or at least interest of the community's highest ideals and most pressing interests" (p. 153). Could they be speaking of capital punishment, justified in the name of protecting the community? But then why mention children?It is true that not everyone can be guaranteed every means to preserving and enhancing life. But this limitation on positive rights is not a "forced giving." Adults may be compelled to risk life--e.g. in a draft for the sake of a war. But, again, the more or less justifiable imposition of a risk is not the same as selecting out one particular individual or class to be directly killed. Neither adults nor born children are compelled to be killed for the sake of organ "donation," even if a greater number might be saved. If one grants equivalent status to the embryo (as the authors seem to do here for the sake of argument), opponents do not have to claim a "super status" for embryos, just the ordinary human right not to be killed even for "compassionate" motives.A second area where I think the authors move too quickly is in their impoverished definition of the essential humanity of the early embryo as exhaustively represented by the physical structure of its DNA. The authors seem to recognize [End Page 103] that, ordinarily, there is more to personhood than sheer physical structure. For example, they mention memories and habits (p. 154). They could also speak of relationships, attitudes, and the like. Since an early embryo has no such components of personality as we experience it, the authors hold that its identity could only be contained in its DNA. Since this DNA is preserved, even spread far and wide, by the use of stem cells, it almost seems as if we are doing the early embryo a favor by breaking it up.However, just because the embryo does not have any conscious memories or other attributes of character or personality, that does not mean its identity is constituted only by its physical structure described statically. The early embryo is not just a bundle of discrete structures, and its DNA is not just an inert lump made up of certain smaller lumps. Both the embryo and its DNA are active. Thus the identity of even an early embryo includes both its current processes and the innate potential for further activity and development. This article addresses the research question: “How do Dutch highly educated Muslim women of Moroccan descent use prayer in dealing with problems?” The theoretical framework was mainly based on the work of Pargament et al. regarding religious coping. The empirical part of the study consisted of a quantitative and a qualitative part. This article presents results of the quantitative part. For the quantitative part of our research, 177 questionnaires were collected using snowball sampling. We asked respondents about their praying practices (...) and their ways of religious coping, using the Brief RCOPE. The connection and communication in their prayer with a loving, caring, benevolent God is the main religious way in which these Muslim women of Moroccan descent cope with all kinds of problems. This use of prayer as a way of coping can be clarified through the psychological functions of religiosity and prayer that are suggested by Pargament, Koenig, and Perez. Prayer could help them in: finding meaning, being master over their circumstances and controlling their emotions, finding comfort and closeness to God, experiencing intimacy with others and closeness to God, and transforming their way of life. We did find few negative religious coping strategies, such as negative feelings towards God or alienation. This is in line with research results of Abu Raiya and Pargament. As Islam implies surrender to God, it may be difficult for Muslims to admit their religious distress, doubts, and struggles. (shrink)

Professional associations, like the Academy of Management, exist to foster and promote scholarship, exchange among faculty, and an environment conducive to member professional ethics development. However, this last purpose of such organizations has received the least amount of attention. Moreover, previous research has demonstrated that there are differences in perceived needs for professional ethics development between tenured and untenured faculty. In the current research 260 Academy of Management members were surveyed. The research identified differences between tenured and untenured management faculty (...) with respect to expectations for the Academy of Management to provide ethics education and research with respect to the professional code of conduct. Implications of the findings are discussed from a developmental perspective. Directions for future research are provided. (shrink)

The distinction between explanation and prediction has received much attention in recent literature, but the equally important distinction between explanation and description (or between prediction and description) remains blurred. This latter distinction is particularly important in the social sciences, where probabilistic models (or theories) often play dual roles as explanatory and descriptive devices. The distinction between explanation (or prediction) and description is explicated in the present paper in terms of information theory. The explanatory (or predictive) power of a probabilistic model (...) is identified with information taken from (or transmitted by) the environment (e.g., the independent, experimentally manipulated variables), while the descriptive power of a model reflects additional information taken from (or transmitted by) the data. Although information is usually transmitted by the data in the process of estimating parameters, it turns out that the number of free parameters is not a reliable index of transmitted information. Thus, the common practice of treating parameters as degrees-of-freedom in testing probabilistic models is questionable. Finally, this information-theoretic analysis of explanation, prediction, and description suggests ways of resolving some recent controversies surrounding the pragmatic aspects of explanation and the so-called structural identity thesis. The aim of this paper is twofold: first to sketch a framework for classifying a wide range of conceptions of scientific objectivity and second to present and defend a conception of scientific objectivity that fills a neglected niche in the resulting hierarchy of viewpoints. Roughly speaking, the proposed ideal of scientific objectivity is effectiveness in the informal but technical sense of an effective method. Science progresses when "higher levels of communicative discourse" are reached by transforming subjective judgments regarding the generation (...) and reduction of data or the testing of theories into objective decision procedures that are automatic or mechanical. The essays discuss Hebrew and Christian Scripture, hermeneutics, and biblical scholarship.

It is argued that current attempts to model human learning behavior commonly fail on one of two counts: either the model assumptions are artificially restricted so as to permit the application of mathematical techniques in deriving their consequences, or else the required complex assumptions are imbedded in computer programs whose technical details obscure the theoretical content of the model. The first failing is characteristic of so-called mathematical models of learning, while the second is characteristic of computer simulation models. An approach (...) to model building which avoids both these failings is presented under the title of a black-box theory of learning. This method permits the statement of assumptions of any desired complexity in a language which clearly exhibits their theoretical content.Section II of the paper is devoted to the problem of testing and comparing alternative learning theories. The policy advocated is to abandon attempts at hypothesis testing. It is argued that, in general, we not only lack sufficient data and sufficiently powerful techniques to test hypotheses, but that the truth of a model is not really the issue of basic interest. A given model may be true in the sense that on the basis of available evidence we cannot statistically reject it, but not interesting in the sense that it provides little information about the processes underlying behavior. Rather, we should accept or reject models on the basis of how much information they provide about the way in which subjects respond to environmental structure. This attitude toward model testing is made precise by introducing a formal measure of the information content of a model. Finally, it is argued that the statistical concept of degrees-of-freedom is misleading when used in the context of model testing and should be replaced by a measure of the information absorbed from the data in estimating parameters.
